PART ONE: TERMS OF SERVICE
1. Acceptance of Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Nomad Model Management LLC (“Nomad,” “we,” “us,” or “our”) governing your access to and use of the website located at www.nomadmgmt.com and all related pages, subdomains, content, features, and services (collectively, the “Website”).
YOUR AFFIRMATIVE ACCEPTANCE OF THESE TERMS (BY CLICKING “I AGREE,” CHECKING THE REQUIRED CONSENT BOX, OR INTERACTING WITH ANY FORM OR DATA INPUT FIELD ON THE WEBSITE) CONSTITUTES YOUR PRIOR, EXPRESS, AND INFORMED CONSENT UNDER CALIFORNIA PENAL CODE § 631(a) AND ALL OTHER APPLICABLE PRIVACY AND COMMUNICATIONS LAWS. IF YOU DO NOT AGREE, DO NOT USE THE WEBSITE.
2. Eligibility
You must be at least 18 years of age to use this Website. By accepting these Terms you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using the Website on behalf of a business or organization, you further represent that you have authority to bind that entity to these Terms.
3. Changes to These Terms
Nomad reserves the right to modify these Terms at any time. When we do, we will update the Effective Date at the top of this document and, where practicable, provide notice via email or a prominent notice on the Website. Your continued use of the Website after any modification constitutes your acceptance of the revised Terms. Because your consent to third-party data transmission under CIPA § 631(a) must be informed and prior, we will present a new clickwrap consent prompt whenever material changes are made to the categories of data collected or the identity of third-party recipients.
4. Permitted Use of the Website
You agree to use the Website only for lawful purposes and in a manner consistent with all applicable local, state, federal, and international laws. You agree that you will not:
- Use the Website to transmit any unsolicited or unauthorized advertising or promotional material;
- Attempt to gain unauthorized access to any part of the Website or its related systems or networks;

6. Disclaimers and Limitation of Liability
THE WEBSITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NOMAD DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NOMAD, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE WEBSITE, EVEN IF NOMAD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
7. Indemnification
You agree to defend, indemnify, and hold harmless Nomad and its officers, directors, employees, agents, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Website; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any claim that content you submitted or transmitted through the Website caused damage to a third party.
8. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the Website shall be resolved exclusively through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, seated in Miami-Dade, Florida, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights.
9. Termination
Nomad reserves the right, in its sole discretion, to suspend or terminate your access to all or any part of the Website at any time, with or without notice, for conduct that Nomad believes violates these Terms or is harmful to other users, Nomad, third parties, or the public, or for any other reason. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
PART TWO: PRIVACY POLICY
Nomad (“Nomad,” “we,” “us,” or “our”) is committed to protecting your privacy. This Privacy Policy explains what information we collect, how we collect it, with whom we share it, why we share it, and what rights you have with respect to that information. This Privacy Policy is incorporated into and made a part of our Terms of Service.
10. California Invasion of Privacy Act (CIPA) — Required Disclosure
California Penal Code § 631(a) prohibits the intentional reading or attempting to read, or to learn the contents or meaning of, any message, report, or communication while the same is in transit over any wire, line, or cable, or being sent from, or received at any place within this state, without the consent of all parties to the communication.
NOTICE: This Website uses third-party analytics, advertising, and customer-relationship tools that may, in the ordinary course of their operation, receive, process, or “read” information you enter into search fields, contact forms, and other data-entry elements on this Website at or near the time of entry—i.e., while such data is “in transit.” Such tools include, but are not limited to, those identified in Section 13 below.
By providing your affirmative clickwrap consent, you expressly and voluntarily consent, as required by FSCA, CIPA § 631(a), and all other applicable laws, to the interception, reading, and processing of any communications or data you enter into this Website by Nomad and by each of the identified third-party service providers. 11.1 Information You Provide Directly
When you interact with any form, search bar, chat widget, or other data-entry feature on the Website, you may provide:

By accepting these Terms you provide your prior, express, and informed consent to each such transmission.

15. Special Notice Regarding Website Search Bars and Form Fields
IMPORTANT: Some third-party analytics, tag management, and session-recording services integrated into this Website may capture keystrokes or text entered into the Website’s search bar(s) and other form fields in real time or near-real time, before you click “Search,” “Submit,” or any other button. This means that partial text you type—even if you do not complete or submit a search—may be transmitted to and processed by third parties listed in Section 13.
Your affirmative clickwrap consent constitutes your prior, express consent to this real-time or near-real-time transmission as required by CIPA Cal. Penal Code § 631(a).
16. Data Retention
We retain personal data for as long as is necessary to fulfill the purposes for which it was collected, to comply with our legal obligations, to resolve disputes, and to enforce our agreements. Specific retention periods vary by data category and applicable law. When data is no longer needed, we securely delete or anonymize it.
17. Data Security
We implement reasonable technical, administrative, and physical safeguards designed to protect your personal data against unauthorized access, disclosure, alteration, and destruction. However, no method of transmission over the internet or method of electronic storage is 100% secure. We cannot guarantee absolute security and disclaim liability for breaches outside our reasonable control.
18. Children’s Privacy
The Website is not directed to children under the age of 18, and we do not knowingly collect personal information from children under 18. If we learn that we have inadvertently collected personal information from a child under 18, we will promptly delete that information. 19. California Privacy Rights (CCPA/CPRA)

- Access the specific pieces of personal information we have collected about you;
- Delete personal information we hold about you;
- Correct inaccurate personal information we hold about you;

- Non-discrimination for exercising your privacy rights.

20. Do Not Sell or Share My Personal Information
Nomad does not “sell” personal information in the traditional sense. However, certain data sharing with advertising partners (such as Meta, Google, and LinkedIn) may constitute “sharing” for cross-context behavioral advertising under the CPRA. By accepting these Terms you consent to such sharing. California residents may opt out of such sharing at any time by contacting us at [email protected]or by using any opt-out mechanism we make available on the Website.

22. Entire Agreement
These Terms of Service and Privacy Policy, together with any additional terms incorporated by reference, constitute the entire agreement between you and Nomad Management with respect to your use of the Website and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral.
23. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.
